Important Changes to the Federal Skilled Worker Program

CIC announced on Friday that the list of qualifying occupations for the federal skilled worker program has been shortened.

If you are a potential applicant, this shows that you are always best to apply as soon as you can, as the rules can (and do) change without notice.

Here is the list of occupations that now qualify for the federal skilled worker program (for those without arranged employment):

Paying the Right of Permanent Resident Fee

Paying the right of permanent residence ree is more complicated than it should be. Citizenship and Immigration Canada does not provide very good instructions when the right of permanent residence fee is requested.

If you are sponsorsing an out-of-Canada spouse, the right of permanent residence fee is best paid online. I typically send a copy of the receipt with the bar code on it to both Mississauga and the consulate which is processing the spouse's application.

For skilled workers, the fee is paid by bank draft or money order to the consulate processing the application. Watch the payable line however, as some consulates require the funds to be payable to the "Receiver General for Canada" and others to the "Canadian Consulate General."

If you don't score 67 points, try for the Canadian Experience Class

f you can not score 67 points - the minimum score required - for the Federal skilled worker program, you do have other options for permanent immigration to Canada.

The Canadian Experience Class requires 24 months of full-time work experience in Canada (there is also a post-graduation scheme that I'll address in another blog).

You work experience in Canada must have been performed legally with a valid work permit,
Applicants must also meet various minimum language requirements depending on their whether their occupation falls within NOC 0, A or B.

The best part? This is a pass/fail category. In other words, there are no minimum points to achieve. You either meet the requirements and pass or you don't. Important factors in the Federal skilled worker program such as education and work history outside Canada are not considered in the Canadian Experience Class category.

So sharpen that resume and start applying to Canadian employers who are willing sponsor you for a position in Canada.

Temporary Resident Permit

For those who are criminally inadmissible, the only way to enter Canada (other than a successful rehabilitation application) is to apply for a temporary resident permit.

Typically the applicant will use the criminal rehabilitation application forms but check the box that says "for information only." However, some offices (such as Buffalo, NY) maintain their own temporary resident permit applications. Check with your local consulate to see which form is required.

Each consulate will have a list of supporting documents, however, they always include criminal record checks, a copy of the statute under which you were convicted, letters of reference, an explanation from you about the circumstances of the offense and subsequent steps you've taken since the offense, and proof that you completed your sentence. Additional supporting documents may be required depending on the circumstances.

As with any application for temporary residence, evidence of connections to your country are critical, and a purpose for visiting Canada should be stated, including length of time and how you will support yourself while in the country.

Medicals no longer required for citizens of certain countries visiting Canada

There have been significant changes regarding citizens of certain countries who no longer required medicals before entering Canada. I quote portions of the CIC news release below:

Ottawa, September 1, 2010 — Most long-term visitors from Mexico, Croatia, the Bahamas and 42 other countries and territories can now enter Canada without a medical exam, Citizenship and Immigration Canada (CIC) announced today. In addition, medical exams will no longer be required for agricultural workers from those 45 countries and territories.

The medical examination requirement remains in place for all temporary residents who will be working in an occupation in which the protection of public health is essential. This includes workers in the health sciences field and those working with children. This announcement does not affect permanent immigrants or refugees, who will continue to be required to undergo a medical examination before entering Canada. Temporary residents planning to stay longer than six months may also need an exam.
